Cancellations
BIG BOY DETAIL LLC is owner operated meaning there is only one individual handling all aspects of the business. There is no additional staff to complete details should personal or health issues arise. Should your appointment need to be moved or canceled, BIG BOY DETAIL LLC will reach out to you as soon as possible to accommodate a new appointment if possible. At the same time, BIG BOY DETAIL LLC does not charge for cancellations, however, it is asked that you let them know as soon as possible so there are no interruptions in operations. Should the client ask to reschedule, a re-schedule deposit may be required.
Pre and Post Service Requirements
Be sure all windows are rolled up, doors are closed, and roofs and sunroofs are completely closed. If any panels, side skirts, wings, or parts of the car are loose, damaged, or otherwise not secured to factory specifications, The customer must let BIG BOY DETAIL LLC know so they can take caution or avoid those areas while working. The customer must also let them know if any parts of the vehicle contain carbon fiber or any vinyl wrap, spray, or any part of the surface that is not factory applied paint. The client must ensure all personal belongings are removed. They may store and lock these items in the glove box as access to the glove box is not needed for service. Remove all drugs, weapons, and other items that may be considered unlawful possession once service starts. Anything left in the vehicle will assumed to be garbage and may run the risk of being thrown out. Do not leave the vehicle unlocked and unattended before or after service. Do not leave keys in the vehicle. BIG BOY DETAIL LLC is not responsible for the security of the vehicle. The customer must let BIG BOY DETAIL LLC know of any chemical allergies or sensitivities 48 hours in advance and the customer must contact us for a list of the chemicals and cleaners we use. It is the duty of the customer to ensure their vehicle is returned to proper operating conditions after service. This includes but is not limited to floor mats being properly secured, head lights being in the proper position, and mirrors being properly adjusted. BIG BOY DETAIL LLC is not responsible for any battery drainage, mechanical, or electrical failure during service.
Pricing, Payment, and Refunds
Clients will receive a quoted package and price via text and/or email via Square prior to the scheduled appointment. Full payment must be received within 24 hours of the invoice being sent via Square to the provided email and/or phone number. Payments can be made via cash and some debit or credit cards. Payments made outside of the 24 hour window may incur a 10% late fee for each day late. Receipts are available upon request. All services are subject to a 7% sales tax. The client will receive a booking confirmation to email and/or text. The base price is included on this booking notice. The prices given by BIG BOY DETAIL LLC are subject to change depending on the condition of the vehicle. BIG BOY DETAIL LLC reserves the right to deny service for any reason or any time. If they chose to provide the service, they will provide an updated price and get approval from the customer prior to the start of service. All sales are final. Customer acknowledges that the products used and the services provided are not a guarantee that the conditions of their vehicle will improve. This includes but is not limited to the removal of stains, scratches, swirls, and other imperfections. If customer notices something on the vehicle that may require corrective action, it is their responsibility to point it out before the business leaves the vicinity. If the customer choses to terminate BIG BOY DETAIL LLC before the service is complete, they are still entitled to pay the full price. BIG BOY DETAIL LLC reserves the right to cancel service due to weather. If the client wishes for service to proceed despite guidance from the technician, they may be entitled to pay for the full service should BIG BOY DETAIL LLC determine it is not safe to continue.
Gift Cards
Gift cards can be used on all services except where excluded. Gift cards can be used for full or partial amounts. If a gift card has an insufficient balance at the time of payment, another form of payment will be required. It is the duty of the cardholder to ensure it has a sufficient balance before service. Media
BIG BOY DETAIL LLC may take images and videos of the client’s vehicle as well as document written and typed statements. I understand that the intended use of such images, statements, and information is solely for the purpose of advertising, testimonials, marketing, charity, social media, fundraising and/or the promotional and public awareness purposes for the organization.
Consent to Communication
The client agrees that BIG BOY DETAIL LLC and their partners may make phone calls, and send text and emails to the phone numbers and emails provided to conduct business and send promotional content.
Service Limitations and Damages
While BIG BOY DETAIL LLC uses products and services to try to improve the overall look and condition of the vehicle, there are certain aspects that they cannot work on. This includes but is not limited to vehicles or objects believed to be used in crime, bodily fluids, scratches, dents, paint chips, bug etching, hard water spots, health and safety hazards, and paint oxidation. BIG BOY DETAIL LLC is not responsible for missing or damaged foreign objects left inside the vehicle. BIG BOY DETAIL LLC is also not responsible for any damages that occur outside of their presence. Certain services may strip existing coatings and ceramics on vehicles. The client acknowledges BIG BOY DETAIL LLC may need to operate their vehicle on private property to complete service. Client acknowledges that carpet and seat shampoo services may leave surfaces damp following service.
Vehicle insurance and Property
By signing this agreement, the client acknowledges they have the proper vehicle insurance, and their vehicle is legally registered with the appropriate state. The client also acknowledges that they have permission from the property owner for services to take place.
Warranty
Any claims of results, duration of products and services, etc. are those made of the manufacture of the product applied. Big Boy Detail does not offer a warranty on any of their services, products, or claims.
No Call No Show
No call no shows will be charged a fee of $0.50 per mile traveled to and from the destination. This fee must be paid before re-scheduling and is non-refundable. To avoid this late fee, the customer must answer communications within 20 minutes of arrival. This includes but is not limited to text, calls, or social media messages. For their safety, BIG BOY DETAIL LLC has a no-knock policy meaning they will not knock on doors or ring doorbells. If an employees arrive at a scheduled location and service is refused by the customer, or the if the vehicle is deemed unserviceable, the customer is entitled to pay the no call no show fee.
Hold Harmless
To the extent permitted by law, Indemnitor shall indemnify and hold harmless the Indemnitee from any and all claims, lawsuits, liabilities, damages and/or injury of any kind whatsoever (including but not limited to monetary loss, property damage, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or administrative action of any federal, state or local governmental body or agency, arising out of any acts, omissions, negligence or willful misconduct on the part of Indemnitor or Indemnitor’s owners, personnel, employees, agents, contractors, invitees, or volunteers. This applies to and includes, but is not limited to, the payment of all penalties, fines, awards, fees and related costs or expenses.
Choice of Law and Venue
This Agreement and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Florida including all matters of construction, validity, performance, and enforcement and without giving effect to the principles of conflict of laws. Any action brought by any party hereto shall be brought within the State of Florida, County of Pinellas.
Attorney Fees
In the event that any suit or action is instituted to enforce any provision in this Agreement, Big Boy Detail and their employees in such dispute shall be entitled to recover from the losing party all fees, costs and expenses of enforcing any right of such prevailing party under or with respect to this Agreement, including without limitation, such reasonable fees and expenses of attorneys and accountants, which shall include, without limitation, all fees, costs and expenses of appeals.
